How should I inform you that I am making changes to my firm (adding an attorney, removing an attorney, firm name change, address change?)

You can change your firm name, address or contact information by submitting your request in writing to Lawyers Mutual.

If you are adding an attorney, have the attorney complete and submit an "Additional Lawyer/Supplemental" application, which can be found on our web site under "Policyholder Forms" section.

If you are removing an attorney, please submit your request in writing (email is fine), giving the name of the attorney and the date he or she was no longer employed with your firm. As a professional courtesy, please send the attorney a copy of this request.

Do I need to notify you that I have hired a non-attorney employee?

Please notify us in writing if you have added a paralegal, investigator, title searcher, patent agent, law clerk or legal assistant.

Whom do I call if I have questions about my policy?

Please contact our underwriting department by calling 800.662.8843.

Do I need to notify you if I have changes in my area of practice?

Changes in areas of practice will be updated when you send us your Re-issue Application. However, if you are considering a representation that involves a new area of practice for your firm, please contact us.

If I add or remove an attorney during the policy period, does it affect my premium?

If you add an attorney, we will send you a Quote/Invoice for the additional premium due. This premium is prorated. When the additional premium is paid, the firm will receive an endorsement stating that the attorney has been added as an Insured under the policy.

If you remove an attorney from your policy, you will receive a prorated refund of premium paid. However, if the firm has an unpaid balance, the refund is applied to the balance due.

How do I request a copy of my Declarations page?

Requests need to be received in writing. We want to confirm that the request comes from you. You can email us or fax us at 919.677.9641.

How do I request a Certificate of Insurance?

Lawyers Mutual does not issue Certificate of Insurance. Upon your request, we can provide a "Confirmation of Insurance."

May I increase the limits of liability under my policy during the term of the policy?

If you wish to increase the limits of liability under your policy, contact us, and we will tell you what we need to determine whether your coverage may be increased.

What is prior acts coverage?

Prior acts coverage is coverage for acts or omissions occurring before the policy effective date. If you have been continuously insured with us, with no lapse in coverage, you will retain your prior acts coverage. The prior acts coverage date for each attorney is stated in the individual's Prior Acts Limitation Endorsement.

What is an Extended Reporting Endorsement (ERE)?

An ERE, often called tail coverage, is an endorsement that provides an additional period of time to make or report a claim. Lawyers Mutual offers a free four-year ERE to attorneys who have been insured with us for 10 years and reach the age of 65, and an unlimited ERE at a substantially reduced premium.

Does my policy provide coverage as an arbitrator or mediator?

Yes. We also offer a Mediator Policy for attorneys who do not need a professional liability policy.

Is coverage available for someone that is working as an attorney on a part-time basis?

Yes, and you may qualify for a substantially reduced premium.

When should I report a claim or incident?

You must send us written notice as soon as you are aware of it. There are two reasons: Your policy requires it, and we may be able to "repair" the error or otherwise help you avoid a claim. Your policy requires that you give us notice as soon as practical upon becoming aware of any act or omission which could reasonably be expected to be the basis of a claim (i.e., a potential claim), and to immediately report any claim that is made or lawsuit filed against you. If you are in doubt about whether an incident should be reported, contact one of our Claims Attorneys. Our Claims Attorneys are North Carolina licensed lawyers, who have practiced with North Carolina law firms and have years of experience in handling claims or potential claims.

What is late reporting?

Late reporting occurs when the attorney is aware of a claim or potential claim but does not promptly report it. Late reporting could result in loss of coverage.

What does "claims-made policy" mean?

Your Lawyers Mutual policy is a “Professional Liability Claims-Made Policy.” The policy is for a term of one year and covers claims duly reported during that year. There must be a policy or ERE in effect at the time the claim is reported to us.

What is Claims Repair?

When a claim is reported to Lawyers Mutual, one of our top priorities is to determine if the error can be corrected or the damage lessened. We call this our Claims Repair program. It is led by an experienced team of in-house claims attorneys and outside counsel who work side-by-side with our insured attorneys in repair efforts large and small.

How do I report a claim?

You may contact one of our Claims Attorneys by calling 800.662.8843. You will be asked to complete an Incident Reporting Form and a brief narrative of the representation and the circumstances of the error. You may be asked to meet with the Claims Attorney and to provide a complete copy of your file.
